When an Occupational Injury Is Also a Disability
When an employee’s occupational injury qualifies as a disability, employers must follow the ADA.
The Americans with Disabilities Act of 1990 (ADA) requires employers to make reasonable accommodations for qualified applicants and employees with disabilities, including employees with occupational injuries that qualify as disabilities. Employer responsibilities under the ADA go beyond simply treating disabled individuals equally. The Act mandates that an employer spend funds and/or change personnel and work requirements in order to accommodate the needs of disabled applicants and employees. [ more ]
