2005: A Year of Insurance Reform
2005 legislation made major changes to the insurance industry in Texas.
Possibly the most significant legislation to be passed last year with regard to insurance was House Bill 7 (HB 7), which abolished the Texas Workers’ Compensation Commission and provided for the creation of a Division of Workers’ Compensation within the Texas Department of Insurance (TDI). The bill also created an Office of Injured Employee Counsel to assist injured employees though the division’s administrative dispute resolution system. The office will advocate on behalf of injured employees during workers’ compensation rulemaking, including rate determinations, by the Commissioner of Workers’ Compensation and the Commissioner of Insurance.
